La diputada presentante, Monserrat Ruíz Páez, explicó que la propuesta busca reformar la Ley de Competitividad y Ordenamiento comercial de la entidad a fin de concientizar a los dueños de comercios a respetar el derecho a la movilidad y evitar la colocación de puestos semifijos o hacer extensiones de sus establecimientos en las aceras o arroyos vehiculares.
“Tiene como finalidad concientizar y en su caso sancionar a los titulares de los comercios que coloquen infraestructura, mercancía o cualquier objeto que obstaculice la vía pública y se genere las condiciones necesarias para el uso correcto de las aceras y los arroyos vehiculares.
De acuerdo con la iniciativa enviada a comisiones legislativas, se busca que en caso de obstaculización de la vía pública por parte de titulares de un permiso o licencia de funcionamiento comercial, se imponga una multa económica de entre 20 y 30 veces el valor diario de la Unidad de Medida y Actualización para establecimientos de bajo impacto, de entre 31 y 40 veces para los de mediano impacto y de 41 a 50 veces para unidades económicas de alto impacto.
Se propone además que a consideración de las autoridades municipales por primera ocasión los establecimientos que incurran en esta práctica de obstaculización de vías públicas, sean exhortadas a cumplir la norma, pero que de reincidir una tercera vez, se sanciones con multas de hasta el doble de los establecido e incluso, se suspenda o cancele el permiso o licencia de funcionamiento.
